Terms of Service

These Terms of Service ("Terms") govern your use of Cozy Servers, a hosted Minecraft server service operated by Red Mesa Studios LLC ("we," "us," or "our"), including the website at cozyservers.com, the control panel at panel.cozyservers.com and the game servers we run for you (together, the "Service").
By creating an account, subscribing or using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy and our Refund Policy, which are part of these Terms. If you do not agree, do not use the Service.
1. Who can use Cozy Servers
You must be at least 18 years old and able to form a binding contract to create an account and subscribe. The account holder is responsible for everyone who plays on or manages their server, including children. If you let a minor play on your server, you are responsible for supervising that use and for deciding who is allowed to join.
2. The Service
We provide a private game server running Minecraft: Java Edition, managed through a web control panel. To keep the Service affordable, your server automatically stops ("sleeps") after a period with no players and starts again ("wakes") when a whitelisted player connects. Wake-up and other timings we describe are typical, not guaranteed. We may update the server software, mods we preinstall, the control panel and our infrastructure from time to time.
3. Your account
Keep your login details secure and your email address current, since we use it to send account, billing and security notices. You are responsible for activity under your account. Tell us right away at support@cozyservers.com if you think your account has been accessed without permission.
4. Subscriptions, billing and automatic renewal
- Price. The Service costs the price shown at checkout (currently $9.00 USD per month), plus any applicable taxes.
- Automatic renewal. Your subscription starts when you check out and renews automatically every month. We charge your payment method at the start of each billing period until you cancel.
- Payments. Payments are processed by Stripe. We do not see or store your full card number.
- Cancelling. You can cancel at any time using the billing link in your welcome email or by emailing us. Cancellation takes effect at the end of the current billing period. Your server keeps running until then, and you are not charged again.
- Failed payments. If a payment fails, we and Stripe will retry it for a short grace period. If it still cannot be collected, your subscription ends and your server is suspended.
- Price changes. We will email you at least 30 days before any price change takes effect for your subscription. If you do not agree, you can cancel before the change applies.
- Refunds. Refunds are covered by our Refund Policy.
5. Minecraft
You need your own Minecraft: Java Edition account to play. Your use of Minecraft, and anything you do on your server, must follow the Minecraft End User License Agreement and Mojang's usage guidelines, including their rules if you ever charge your own players for anything. Cozy Servers is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. "Minecraft" is a trademark of Mojang Synergies AB.
6. Acceptable use
You agree to use the Service only as allowed by our Acceptable Use Policy. In short: use your server to play Minecraft with people you choose, and do not use it for anything illegal, harmful or abusive.
7. Your content
Your worlds, builds, configuration files, mods and other files you or your players put on your server ("Your Content") remain yours. You give us permission to store, copy, back up, transmit and process Your Content only as needed to run, secure and support the Service. You are responsible for Your Content and confirm you have the rights to upload it, including any mods, plugins or resource packs. We do not routinely review Your Content, but we may remove or disable access to content that we believe breaks these Terms or the law. Copyright complaints are handled under our Copyright Policy.
8. Backups, data and deletion
The control panel lets you make backups of your server. We take reasonable care of your files, but no service can rule out data loss, so please keep your own copies of anything important; you can download your files at any time through the control panel. When your subscription ends, we suspend your server and keep its files for 30 days in case you return. After that, the server, its files and its backups are permanently deleted.
9. Availability
We work to keep the Service running smoothly, but we do not promise it will be uninterrupted or error-free. We may perform maintenance, sometimes without advance notice, and outages can happen for reasons outside our control, such as hardware failures, network attacks or problems with third-party services, including Minecraft's own login services.
10. Suspension and termination
You may stop using the Service and cancel at any time. We may suspend or end your access if you break these Terms or the Acceptable Use Policy, if your payment cannot be collected, if required by law, or if your use puts the Service, other customers or third parties at risk. Where reasonable, we will tell you why and give you a chance to fix the problem first. If we end the Service for everyone, we will give you at least 30 days' notice and refund any prepaid amount for time you cannot use.
11. Changes to the Service and these Terms
We may change the Service or these Terms. If a change to these Terms is material, we will notify you by email or on our website at least 14 days before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms; if you do not agree, you can cancel.
12. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, to the maximum extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, Red Mesa Studios LLC and its owners, officers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data (including worlds and builds), goodwill or other intangible losses, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the six months before the claim arose or fifty U.S. dollars ($50.00).
14. Indemnity
You agree to defend and indemnify Red Mesa Studios LLC against claims, damages and costs (including reasonable legal fees) arising from Your Content, your use of the Service or your breach of these Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any dispute that is not resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and you and we consent to their jurisdiction. Either party may instead bring an eligible claim in small claims court.
